Eva Carneiro 'taking legal action against Jose Mourinho'

Chelsea manager Jose Mourinho is to be the subject of an individual legal claim from former club doctor Eva Carneiro, the Press Association is reporting.

Carneiro left Chelsea in September after having been stripped of her duties following a controversial incident in the club's opening game of the season against Swansea City.


Carnerio and physio Jon Fearn entered the field of play to deal with the injured Eden Hazard and Mourinho reacted furiously.


He appeared to hurl abuse at Carneiro at the time - something for which he avoided an FA investigation - and was openly critical of his medical staff in his post-match press conference.


Carneiro subsequently left the club and haslaunched a constructive dismissal case against Chelsea. Now Mourinho himself is to be the subject of legal action by the doctor.










The news agency explained:



Press Association Sport understands that legal papers will be served on Mourinho this week as part of separate but connected claims against him and against the club. It means the Portuguese manager will have to appear in person at an employment tribunal unless the case is settled out of court beforehand. Under employment law, an individual can be personally liable for damages if victimisation or discrimination can be proved. The claim against Mourinho will be on the basis that he was instrumental in the actions against Carneiro in having her dropped from first-team duties and effectively demoted.



Mourinho said after the draw against Swansea in August: "Even if you are a kit man, doctor or secretary on the bench, you have to understand the game. You have to know you have one player less and when you go to the pitch to assist a player, you have to make sure your player has a serious injury.


"I was sure he hadn't a serious problem. He had a knock, he was very tired. But my medical department - on an impulse - was naive and left me with eight outfield players in a counter-attack after a set piece."


Carneiro was backed by professional medical bodies who stated she had a duty of care to attend to Hazard, and her exit from Chelsea prompted strong criticism from FA board member Heather Rabbatts.


According to the Press Association, Mourinho could himself be personally liable if Carneiro's legal action is a success.






PA added in their report: "The doctor's lawyers said neither she nor they could comment as the case is sub judice. Chelsea did not respond when asked if they wished to comment."


The Chelsea manager is having a terrible season with reports suggesting he is close to the sack after losing six of the first 11 Premier League games of the season.
